Public Charging User Terms

These terms (the “Public Charging Terms”) govern your use of the charging feature in the Application (the “Charging Feature”), which includes the ability to charge your Vehicle at supported public charging station networks (“Supported Networks”) and pay for those charging sessions with a payment method you have on file in the Application. The Charging Feature is an Application Service. As such, these Public Charging Terms incorporate by reference the User Terms for Application Services (https://www.onstar.ca/content/dam/onstar/na/ca/en/downloads/MobileApp_CA_EN_UserTerms_05012018.pdf) and the User Terms for Connected Vehicle Services (https://www.onstar.ca/en/legal/user-terms) (each of which are available at onstar.ca), (collectively, the “User Terms”). Together, these Public Charging Terms and the User Terms are binding between you and us and govern your access and use of the Charging Feature. In the event of a conflict between these Public Charging Terms and the User Terms, these Public Charging Terms will control. Capitalized terms used but not defined in these Public Charging Terms have the meanings set forth in the User Terms.
For charging sessions initiated through Supported Networks in the Application, the charging services are sold by the applicable charging network, which is the merchant of record for those transactions. General Motors of Canada Company and/or its affiliates (collectively, “GM”) does not sell charging services. GM’s role is limited to facilitating access and payment to Supported Networks. Users must comply with all applicable terms and policies of the Supported Networks (“Supported Network Terms”); for example, Tesla’s station and charger policies available at https://www.tesla.com/legal/terms apply when using Tesla‑owned charging stations.
Subject to applicable law, we may modify any part of the Public Charging Terms at any time by giving you notice or by posting an updated version of these Public Charging Terms through the Application. Your continued use of the Charging Feature after any modification of the Public Charging Terms represents your agreement to be bound by the Public Charging Terms as updated.
Your OnStar and Connected Vehicle Services Subscription and GM Public Charging Payment Methods
- To use the Charging Feature, you must maintain at least one valid and supported payment method on file in the Application and designate that payment method as your payment method of choice for use with the Charging Feature.
- The payment method you select to use with the Charging Feature must be the same as the payment method you use to pay for any OnStar and connected vehicle services subscription or recurring paid plan. If you select a new payment method for the Charging Feature when you sign up to use the Charging Feature, GM will also use that payment method for any recurring OnStar and connected vehicle services subscription payments you may have.
- If you change your OnStar subscription payment method in the future, the new OnStar subscription payment method will be added to your saved payment methods in the Application and will be used as your designated payment method with the Charging Feature.
- Any person who uses your vehicle and has access to your account may be able to access and use the Charging Feature, and you will remain responsible for payment of the applicable charges.
Charging Feature Fees and Charges
- For charging sessions at Supported Networks, you are purchasing charging services from the Supported Network, which is the merchant of record. GM does not sell charging services. You authorize GM to charge your designated payment method for amounts you owe to the Supported Network and to collect and remit those amounts to that Supported Network. A temporary payment authorization hold will be placed on your payment method at the start of each charge session, and the balance of the authorization will be released when your charge session is complete and successfully paid.
- By charging your Vehicle at a participating public charging location, you agree to pay all applicable fees associated with that charging station session, including but not limited to the following fees: energy fees, idle fees, and congestion fees. You may incur idle fees or congestion fees for the time your Vehicle remains parked in a charging stall or connected to a charging station after it is finished charging.
- You will receive an email receipt after you complete charging.
Additional Terms for the Charging Feature
- You will only use the Charging Feature for legitimate business or personal purposes, and not for resale.
- We may suspend or terminate your use of the Charging Feature at any time, with or without notice, if you do not comply with these Public Charging Terms.
- We may remove or discontinue the Charging Feature at any time and for any reason without further notice to you and without liability to you.
- We strongly advise you to use a GM NACS adapter for charging on the NACS public charging network, which adapters have been designed for charging GM EV batteries. Damage to vehicle components resulting from the installation or use of non-GM approved parts is not covered under the terms of the vehicle warranty and may affect remaining warranty coverage for affected parts. Some charging network providers may prohibit the use of certain adapters pursuant to their terms of use and policies.
- Except as set forth in the User Terms or as required by applicable law, GM will not be liable for any damage or loss suffered as a result of your use of the Charging Feature, a public charging station, or the payment process, including, without limitation, any damage or loss suffered as a result of the use of non-GM approved adapters or a violation of Supported Network Terms.
- To enable activation, billing, fraud prevention, customer support, and dispute resolution, the Supported Network will share session information with GM (e.g., session start/stop times, energy dispensed, station IDs, fees and taxes). You acknowledge that GM may collect, use, disclose, and process information associated with your use of the Charging Feature, in accordance with the GM Privacy Statement for Application Services and the Connected Vehicle Privacy Statement (available at https://www.onstar.ca/en/legal/privacy-statement).

The Charging Feature is an Application Service. Tesla’s station and charger policies also apply when you use the Charging Feature, when you visit a Tesla station, or when you use a Tesla Supercharger (the “Tesla Policies”). The Tesla Policies may be found at https://www.tesla.com/legal/terms.
